Terms of Service
Last updated 4 November 2026
These Terms of Service are the agreement between you and CallNotes AI for your use of CallNotes AI. Please read them - creating an account means you accept them.
1. Agreeing to these Terms
By creating an account, or by using CallNotes AI (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account or use the Service.
CallNotes AI (“we”, “us”) provides the Service. If you use it for a business, you confirm that you have authority to accept these Terms for that business.
2. Your account
- You must be at least 18 years old.
- You must give a real email address that you control, and keep your details accurate.
- Keep your password secret. An account is for one person - do not share your login.
- You are responsible for everything done through your account. Tell us promptly if you think someone else has got into it.
3. What the Service does
CallNotes AI transcribes the audio picked up by the microphone or audio source you choose, shows the transcript live with each speaker labelled, and - when you ask - uses artificial intelligence to turn the transcript into talking points, next steps and appointments. Your calls are saved to your account.
To do this it sends audio and transcripts to other companies, listed in our Privacy Policy.
Know its limits. A web page on a phone cannot capture the audio of that phone's own call. Speaker labels are worked out automatically and can be wrong, especially when more than two people speak or people talk over each other. A transcript is not a word-perfect record.
4. Recording and consent - your responsibility
Transcribing a conversation is a form of recording it. The law on recording and transcribing conversations differs from place to place, and in many places everyone in the conversation must be told, or must agree, first.
- You are solely responsible for knowing the laws that apply to you and to the people you speak with, and for giving every notice and getting every consent they require before you start a transcription.
- The Service does not tell the other people that they are being transcribed. That is up to you.
- Do not use the Service where recording or transcribing is not allowed, and stop if someone objects.
- We do not give legal advice. If you are unsure what you need, ask a lawyer.
5. Your content
Your “Content” is what you put through the Service: the audio you stream, the transcripts, the notes and tags you create, and your account details.
You own your Content. You give us permission to store it, process it and show it to you, and to send it to the service providers named in the Privacy Policy, but only as far as needed to run the Service for you.
We do not sell your Content, use it for advertising, or use it to train our own AI models. Our service providers handle it under their own terms, described in the Privacy Policy.
You promise that you have the right to put your Content through the Service, including the consents described above.
6. AI-generated notes can be wrong
Summaries, talking points, dates and appointments are produced by an AI model. They can be incomplete, wrong or misleading, and a spoken date may be read incorrectly. Check them against the transcript, and with the person concerned, before you rely on them.
The Service is a note-taking aid. It is not legal, financial, tax or real estate advice, and you remain responsible for your own decisions and for what you tell your clients.
7. Acceptable use
You agree not to:
- break the law, or record or transcribe someone without a consent the law requires;
- use the Service to harass, threaten, deceive or defraud anyone;
- try to get into someone else's account, or into our systems or data;
- copy, scrape, reverse-engineer or resell the Service, or give others access to it, except as the Service itself allows;
- overload or interfere with the Service, or get around its limits - including by opening many accounts to avoid usage allowances;
- upload malicious code, or use the Service to send spam.
We may limit or suspend accounts that do any of this.
8. Plans, limits and payment
The Service has a Free plan and a paid Pro plan. Each has a monthly allowance of transcription minutes and analyses, shown on our pricing page. Allowances reset at the start of each calendar month (UTC), and unused allowance does not carry over.
Pro is a subscription billed in advance, monthly, quarterly or yearly as you choose. Payments are handled by Stripe; we never see or store your card number.
A subscription renews automatically at the end of each period, at the price shown when you subscribed (unless we tell you about a change first), until you cancel.
You can cancel at any time from your account page. Cancelling stops the next renewal, and you keep Pro until the end of the period you have paid for. We do not refund part-used periods, except where the law requires.
If a payment fails, Stripe may try the card again. If it is still not paid, your account returns to the Free plan.
If we change our prices, the new price applies from your next renewal and we will tell you beforehand.
Nothing in these Terms limits any consumer right you have that cannot be excluded.
9. Availability and changes
We work to keep the Service running, but we do not promise that it will always be available or free of errors. It relies on other companies' services (for transcription and AI) and on your device, microphone and internet connection.
We may change, add or remove features, and may pause the Service for maintenance. If a change materially reduces what a paid plan gives you, we will tell you and you can cancel.
10. Ending your account
You can delete your account at any time from your account page. That permanently deletes your saved calls and cancels any subscription; the Privacy Policy explains how long copies may remain in backups. You can download your data first.
We may suspend or close an account if you break these Terms, misuse the Service, do not pay, or if the law requires. If we close an account for a reason other than your breach, we will refund the unused part of any period you have paid for.
The parts of these Terms that by their nature should continue - such as the sections on recording and consent, liability and your responsibility for claims - continue after your account ends.
11. No warranty
To the fullest extent the law allows, the Service is provided “as is” and “as available”, without any promise that transcripts or AI notes will be accurate or complete, that the Service will meet your needs, or that it will run without interruption.
12. Limit of liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, lost deals, lost commissions or lost data, arising from your use of the Service.
Our total liability to you for all claims relating to the Service is limited to the greater of what you paid us in the 12 months before the claim arose and US$100.
Nothing in these Terms limits a liability that cannot be limited by law, or a consumer right that cannot be excluded.
13. Your responsibility for claims
You agree to cover us for claims, losses and reasonable costs brought by a third party that arise from your Content or from your breach of these Terms or of the law - including recording or transcribing someone without a consent the law required.
14. Changes to these Terms
We may update these Terms. The date at the top shows when they last changed. For a material change we will email you or show a notice in the Service before it takes effect. If you keep using the Service after that, you accept the new Terms; if you do not agree, stop using it and delete your account.
15. Governing law
These Terms are governed by the laws of the place where we are based, and disputes are for the courts there. Nothing here removes protections that the law where you live gives you and that cannot be waived.
